Getting hit by another car in Maryland can be life-changing. Car accidents can be anywhere from trivial to devastating, but most of them can end with you paying thousands of dollars in medical and repair costs to make a full recovery and get back on your feet.
How much you can get for a car accident in Maryland depends, obviously, on how bad the crash was. The purpose of personal injury law is, after all, making sure you get the compensation that you deserve, and that compensation is limited to what you have suffered.
Getting that full amount, though, is easier said than done, and often takes a skilled personal injury attorney to see your case through to the end. The Maryland attorneys at Gilman & Bedigian have represented countless clients get the compensation they need and deserve after car crashes.
Legal Damages After a Car Accident in Maryland
You can get compensation for all of the legal damages that you suffer in a Maryland car accident. Your “legal damages” represent all of the ways that the law recognizes you can be hurt in an accident. These damages are far-reaching and extend well past just the cost of the medical care that you have received. They can be divided into two major categories: economic and non-economic damages.
Each of these can be further divided into smaller segments that, together, encompass all of the ways that you have been harmed in the crash and all of the ways you deserve to be compensated.
Your Economic Damages
Your economic damages are the ways that you have been hurt in the accident and that can easily be stated in a dollar amount. Economic damages are the costs of the obvious injuries that you have suffered and can include the following.
- Medical Bills. If you get hurt in the crash, you will need medical attention and care to make a full recovery. Because that care costs you money—money that you would not have had to spend were it not for the crash that was caused by someone else—you deserve to be compensated for every dollar that you have spent on it.
- Future Medical Care. Many injuries have long-term effects that will take care and recovery time well into the future. When those injuries were from the crash that was caused by someone else, there is no reason why you should be the one to pay for them. Instead, you should be compensated for what you will have to pay in the future by the person or the people who were responsible for the injuries occurring, in the first place.
- Lost Wages. If you had a job or were earning an income at the time of the crash, there is a distinct possibility that your performance at work suffered or that you had to miss time. If this caused you to lose wages that you would have earned, were it not for the accident, then those lost wages become part of your legal damages and you can get them back as compensation in a personal injury lawsuit.
- Missed Earning Potential. In some cases, especially in those where you have been hurt badly and will be at least partially disabled for a period of time, you might be unable to keep your job or will miss out on an expected promotion. You should be compensated for this loss in your earning capacity, and you can get this compensation in a successful car accident lawsuit.
- Property Damage. Finally, the costs of repairing or replacing any property damage that you suffered in the car crash—typically to your vehicle, but also to anything that was inside your vehicle at the time of the crash—can be recovered in a personal injury lawsuit after a car accident.
Your Non-Economic Damages
The non-economic damages that you suffer in a Maryland car accident are far more difficult to state in a dollar amount. Just because they are tricky to compute, though, does not mean you did not suffer them. Therefore, you should be compensated for them.
- Pain and Suffering. Physical injuries hurt. Some are debilitating. Even if you were to be compensated for all of the medical bills, you would still feel undercompensated because of all of the pain you went through, and because of the things you can no longer do. That is why Maryland law allows you to recover for your pain and suffering in a personal injury case.
- Your Family’s Loss of Consortium. In some cases, your family may have also suffered, as well. Your absence and the stability that you provide may have put them in dire straits that they would not have experienced if the crash had never happened. You can also get compensation for this loss of consortium in a personal injury case.
Non-Economic Damages are Capped in Maryland
Unfortunately, the amount that you can get in compensation for your non-economic damages is capped in Maryland, with the maximum amount you can get depending on when the accident occurred and the type of case you are pursuing. If you are seeking compensation for your own injuries—that is, you are not pursuing a wrongful death case where a loved one suffered fatal injuries in the crash—and the accident happened between October 1, 2017 and October 1, 2018, then you can only receive up to $845,000 in compensation for your non-economic damages. This dollar amount increases by $15,000 every year.
