Taxi cab drivers seem to operate by a different set of rules than other drivers. When you are in a hurry to get to the airport, a taxi’s aggressive driving can be a real benefit. However, when you are not a passenger, their same aggressive driving can result in an accident. This can lead to serious injury and major vehicle damage. Taxi drivers are not likely to admit fault in an accident. In order to be compensated for your damages, you may have to turn to an experienced attorney to fight for you.
An accident involving a taxi will be much more difficult to deal with than an accident with another car. Taxi drivers will almost never admit that they caused an accident, no matter how obvious it is. Driving is their livelihood, and if they are found responsible, it may affect their employment. Going to the taxi company may not be any easier to deal with. They will want to avoid paying out a dime, and without serious pressure, they may not even return your phone calls. Legal action may be your only recourse after an accident involving a taxi.
Car Accidents Involving a Taxi
Taxi drivers have a knack for cutting through regular traffic quickly. This may involve speeding, passing a vehicle on the left, turning in front of other cars, rolling through stop signs, and even running red lights. Most of the time, they get away with it, leaving a regular driver honking their horn or waving an angry fist. However, when they hit another car the driver and passengers can suffer serious injuries.
Accidents involving taxis are often caused by a negligent cab driver. They may not admit to any mistake, but speeding and violating traffic laws are often the cause of the accident. Taxi drivers may also be talking on the phone, or using a mobile device while driving. Distracted driving is another common cause of accidents involving a taxi.
After an accident involving a taxi, make sure you get their license plate number. A taxi driver may take off to try and avoid responsibility for the accident. If possible, see if there are any witnesses to the accident, and get their contact information. If the taxi driver left the scene of an accident, call the police. A police report may help your case, and may be required by your insurance company.
Taxi Accidents as a Passenger
Taxi companies are considered common carriers, just like buses, trains, and airplanes. As a common carrier, cab companies owe their passengers a duty of care. If the taxi driver breaches their duty of care, which causes injury to a passenger, then the driver and the taxi company may be liable for the injuries caused, including physical damages, medical bills, future medical costs, lost wages, and even pain and suffering.
Passengers in a cab are especially susceptible to injuries because they often do not use a seatbelt while riding in a taxi. Seatbelts are a primary safety feature in most car accidents. They are intended to secure the occupant in place, to they do not move about after an accident. An unsecured passenger can strike the interior of the vehicle in an accident, hitting the window, side door, or barrier between the front and rear of the taxi.
Filing a Claim After a Taxi Accident
The most frustrating part of an accident involving a taxi is trying to deal with the cab company. The driver will not take responsibility, and the taxi company will likely try to avoid responsibility as well. If you call to report the accident, they may not even return your call. After repeated attempts, they may take down your information, and never get back to you. It may take weeks of constant phone calls before they do anything about the accident.
When a taxi driver gets into an accident, both the driver and the employer may be liable for the injuries caused. The employer may be vicariously liable for their employee’s negligence, and can be named as a defendant in a personal injury lawsuit. For an injured driver, this may mean that even if the driver does not have enough insurance to cover the damage, the taxi company will likely have greater financial resources.
Instead of trying to fight the insurance company and taxi cab company on your own, let your personal injury attorney work for you. Most experienced personal injury attorneys will offer a no-cost consultation. Additionally, personal injury attorneys may offer a contingent fee arrangement, so you will pay nothing up-front. Your attorney will only be compensated for their services once you have won your case, and recovered damages from the parties responsible.
